1Acceptance of Terms and Binding Agreement

By registering an account, purchasing credit tokens, or interacting with the services, APIs, and workspace utilities provided by MOKZERO ("Platform", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding contract between you and the Platform. If you do not agree to all provisions within this agreement, you must not use or access the Platform.

2Account Security and API Restrictions

You are entirely responsible for protecting your account credentials and session tokens. You must immediately notify us of any security compromise or unauthorized access. You agree not to:

• Circumvent or attempt to bypass billing allocations, token limits, or API rate limitations.
• Deploy automated web crawlers, scrapers, bots, or scripts to access, query, or extract data from the Platform.
• Decompile, reverse engineer, or disassemble the Platform's algorithms, proprietary styling, or backend endpoints.

3Billing, Tokens, and Absolute "No Refunds" Policy

Certain generation requests compute and deduct credit tokens. Account balances, promotional packages, and recurring billing cycles are managed within database contexts. Payments are processed securely via external merchants (Stripe, PayPal, Razorpay, or Flutterwave).

**ABSOLUTE NO REFUND POLICY:** All token package acquisitions, subscription balances, and transaction fees are final and non-refundable. We do not provide refunds or credits for partially used billing cycles, unused tokens, or service interruptions, except where required by local consumer protection statutes.

4User Content Ownership and IP Rights

You retain all right, title, and ownership interest in the prompt sequences you input and the resulting output creations (texts, layouts, code, images, audio) synthesized for you by the Platform's model adapters.

However, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to host, parse, cache, and transmit your input/output content solely to deliver, diagnostic, and improve the Platform's tools.

**Output Uniqueness Disclaimer:** Due to the mathematical nature of machine learning algorithms, generations may not be unique across users. Similar prompts may produce similar or identical outputs. The Platform disclaims any warranty that your generated content is unique or free from third-party copyright claims.

5Platform Intellectual Property

The software, code bases, layouts, typography, logos, graphics, icons, server structures, databases, and custom themes are the exclusive intellectual property of the Platform and its licensors. You are granted a limited, personal, non-transferable, and revocable license to access the Platform for your personal or commercial production. You are prohibited from copying or rebranding our Platform.

6Warranty Disclaimer ("AS-IS" Provision)

Critical Legal Protection

THE PLATFORM AND ALL AI-GENERATED OUTPUTS ARE PROVIDED TO YOU ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title. We do not warrant that the outputs generated by the AI models will be accurate, error-free, factual, secure, or appropriate for your legal, financial, medical, or business applications. You rely on generated materials solely at your own risk.

7Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PLATFORM, ITS DEVELOPERS, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR INABILITY TO ACCESS THE PLATFORM;
• ANY CONDUCT, LOG OUTAGES, OR CONTENT OF THIRD-PARTY AI API PROVIDERS;
• ANY CONTENT GENERATED OR INACCURACY RENDERED BY THE SERVICE;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR GENERATIONS.

**Liability Cap:** Our aggregate liability for all claims arising out of or relating to these Terms shall not exceed the lesser of $100.00 USD or the total fees paid by you to the Platform in the twelve (12) months preceding the claim.

8Indemnification

You agree to defend, indemnify, and hold harmless the Platform, its developers, contractors, and hosting partners from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Platform, including any generated outputs you utilize or publish;
• Your violation of any term of these Terms of Service;
• Your violation of any third-party rights, including copyright, trademark, privacy, or property rights.

9Class Action Waiver & Binding Arbitration

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be settled by binding individual arbitration, and not in a court of law.

**CLASS ACTION WAIVER:** YOU AND THE PLATFORM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10Suspension and Termination

We reserve the right, in our sole discretion and without prior notice or liability to you, to suspend, terminate, or delete your user account, block your IP address, or revoke your access to Platform tools if you violate these Terms, engage in behavior that harms other users, or abuse Platform APIs. Upon termination, your right to use the Platform ceases, and all unused token allocations are forfeited immediately.
